The Board’s Lawsuit Against Disney: Should it Stay or Should it Go?

Disney filed a motion to dismiss the CFTOD Board’s lawsuit in Florida state court.

As a recap, Disney entered into development contracts with the outgoing Board of the special district. When the DeSantis’ appointed board came in, they realized that they would be essentially handcuffed by these contracts.

The Board therefore filed the lawsuits asking the Florida state court to rule that the contracts are void and unenforceable.

After the filing of this lawsuit, the Florida Legislature passed SB 1604, which stated that any contracts entered into within three months of a change in the structure of a special district board cannot be enforced without first allowing the incoming board an opportunity to affirm the contracts.

Of course, the CFTOD Board did not affirm the contracts.

Since this new law made the development contracts void and unenforceable, Disney argues that there is no longer any need for the court to weigh in on the issue–it is already decided.
